This document (hereinafter "Agreement") constitutes a legally binding agreement between the end-user of the service (hereinafter "User" or "You") and QuizVDS (hereinafter "QuizVDS", "We", or "Us"), the owner and operator of the web platform `https://exam.quizvds.it/` (hereinafter "Platform") and its related mobile applications (hereinafter "Apps"). Accessing, browsing, or using any of our services implies full and unconditional acceptance of all terms and conditions set forth herein.

Art. 1 - Definitions

For the purposes of this Agreement, the following terms shall have the meanings specified below:

• Digital Content: Any data produced and supplied in digital form, including, but not limited to, texts, quizzes, simulations, images, videos, and software made available through the Platform or the Apps.
• Service: The set of features, content, and utilities offered by QuizVDS through the Platform and/or the Apps.
• Access Plans: Time-limited packages that allow access to the Digital Content of the Platform, purchasable via a one-time payment.
• Third-Party Stores: Digital distribution platforms managed by third parties, such as the Apple App Store and Google Play Store, through which the Apps are distributed and sold.
• Parties: The User and QuizVDS jointly considered.

Art. 2 - Subject Matter and Scope of the Agreement

2.1. This Agreement governs the provision and use of the Service, defining the rights and obligations of the Parties.

2.2. The Service is intended to provide support tools for exam preparation. QuizVDS is not an accredited training institution and does not issue any kind of titles or certifications. The Service is for educational and self-assessment purposes only.

2.3. The use of the Service is strictly personal and may not be transferred or shared with third parties.

Art. 3 - Registration and Account Management

3.1. To access certain features of the Service, the creation of a personal account is required. The User agrees to provide accurate, complete, and up-to-date information during the registration process.

3.2. The User is solely responsible for the custody and confidentiality of their access credentials (username and password). The User agrees to immediately notify QuizVDS of any unauthorized use of their account or any other breach of security.

3.3. QuizVDS shall not be held liable for any damages or losses resulting from the User's failure to comply with the security obligations set forth in this article.

Art. 4 - Economic Conditions and Purchase Methods (Web Platform)

4.1. Nature of Access Plans: The Platform offers Access Plans with predefined durations (e.g., 1, 3, 6 months). The purchase of a Plan constitutes a "one-time payment". The service is not a subscription and does not involve automatic renewals or recurring charges.

4.2. Purchase Process: Upon expiration of the Access Plan, the User's account will cease to have access to the paid Digital Content. The User will have the option, but not the obligation, to purchase a new Plan to restore access.

4.3. Fees and Currency: The prices of the Plans are indicated on the Platform and are expressed in Euros (EUR), inclusive of VAT, if applicable. We reserve the right to change prices at any time, provided that the price applied to the User will be the one in effect at the time of the order.

4.4. Payment Processors: Payments are processed by third-party payment service providers (e.g., Stripe, PayPal). QuizVDS does not collect or store sensitive financial data. The User is subject to the terms and conditions of the chosen payment processor.

Art. 5 - Conditions Regarding Mobile Applications

5.1. The purchase, download, and management of the Apps occur exclusively through Third-Party Stores. Consequently, all financial transactions, management of any in-app subscriptions, and refund policies are governed exclusively by the terms and conditions established by Apple Inc. and Google LLC.

5.2. Any refund request or issue related to a payment made through a Third-Party Store must be addressed directly to the customer service of the respective store.

Art. 6 - Right of Withdrawal and Exceptions

6.1. Pursuant to and for the purposes of Art. 59, paragraph 1, letter o) of the Italian Legislative Decree 206/2005 (Consumer Code), the 14-day right of withdrawal is excluded for the supply of digital content on a non-tangible medium.

6.2. By placing an order on the Platform, the User requests that the performance of the contract begins immediately, before the withdrawal period expires. To this end, during the purchase process, the User must provide their explicit consent via a specific checkbox, confirming their awareness that such consent entails the loss of the right of withdrawal.

6.3. In the absence of such explicit consent, the transaction cannot be completed.

Art. 7 - License to Use and Intellectual Property

7.1. All intellectual and industrial property rights related to the Service and the Digital Content, including, without limitation, software, texts, quizzes, graphics, logos, trademarks, and know-how, are the exclusive property of QuizVDS or its licensors and are protected by applicable national and international laws.

7.2. In exchange for the payment of the fee, QuizVDS grants the User a limited, non-exclusive, personal, non-transferable, and non-sublicensable license to access and use the Digital Content for personal and non-commercial purposes, solely for the duration of the purchased Access Plan.

7.3. The User is expressly forbidden from: reproducing, modifying, distributing, selling, renting, decompiling, reverse-engineering, or creating derivative works based on the Service or its content.

Art. 8 - User Conduct and Prohibited Uses

The User agrees not to use the Service for illegal or unauthorized purposes. It is strictly forbidden, by way of example and not limitation, to engage in any act aimed at:

• Accessing the Service via bots, spiders, or other automated means.
• Interfering with the proper functioning of the Service or the servers and networks connected to it.
• Attempting to circumvent the security measures of the Platform.
• Using another user's account without authorization.
• Publishing defamatory, obscene, illegal, or offensive material.

Art. 9 - Suspension and Termination of the Agreement

9.1. QuizVDS reserves the right to suspend or terminate, with immediate effect and without prior notice, a User's account and their access to the Service, should the User violate any of the provisions of this Agreement, or should their conduct pose a risk to the security or integrity of the Service or other users.

9.2. In the event of termination due to the User's breach, the User will not be entitled to any refund for the remaining period of the Access Plan.

Art. 10 - Quality of Service and Disclaimer of Warranties

QuizVDS is committed to making every reasonable effort to provide a high-quality Service, keeping the educational content as accurate and up-to-date as possible, and ensuring a stable and secure technological infrastructure. We are also committed to providing timely support to resolve any issues reported by users.

Notwithstanding the foregoing, the User acknowledges and agrees that, given the nature of digital services, the Service is provided "as is" and "as available," without warranties of any kind, either express or implied.

In particular, QuizVDS does not warrant that:

1. The Service will always operate uninterrupted, error-free, or completely secure.
2. The results obtained from the use of the Service will meet the User's personal expectations, including, but not limited to, passing exams or competitions.
3. Any errors in the content or software will be corrected immediately.

The use of the Service is, therefore, at the User's complete risk and discretion.

Art. 11 - Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall QuizVDS or its owner be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from (i) access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service. The total liability of QuizVDS for any claim arising from this agreement shall in no case exceed the total amount paid by the user to QuizVDS in the six (6) months preceding the event giving rise to the claim.

Art. 12 - Indemnification

The User agrees to defend, indemnify, and hold harmless QuizVDS and its owner from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with their access to or use of the Service or their violation of these Terms.

Art. 13 - Miscellaneous

13.1. Force Majeure: Neither Party shall be liable for failures caused by events beyond its reasonable control (e.g., natural disasters, wars, acts of terrorism, communication network failures).

13.2. Severability: Should any provision of this Agreement be deemed invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of the Agreement will remain in full force and effect.

13.3. Entire Agreement: This Agreement constitutes the entire and exclusive agreement between the Parties regarding its subject matter and supersedes any prior agreements, written or oral.

13.4. Communications: Any communication regarding this Agreement must be sent to the email address provided in the Contacts section.

Art. 14 - Governing Law and Jurisdiction

This Agreement is interpreted and governed in accordance with the laws of the Italian Republic. For any dispute arising from or related to this Agreement, the Parties agree to submit to the exclusive jurisdiction of the Court of Brescia (IT).
